About utmaningsrätt
Utmaningsrätten is a way for municipalities to find new solutions and partners for all their current and future needs.
Utmaningsrätt means that a municipality or a county council by a formal decision agrees to examine all proposals received on alternative provisions of service currently conducted in-house, or not offered at all in the municipality. If the activity is considered suitable for competition, a public procurement process is initiated.
Utmaningsrätten is a relatively new phenomenon in Sweden. In 2007 only three municipalities adopted the right to challenge. By 2011, 40 municipalities and one county council have adopted the right.
By adopting the right to be challenged, a municipality has rolled out the red carpet for entrepreneurs and opened up for social and technical innovation. How the right to challenge is formulated and how extensive it is, can vary from municipality to municipality. But in most municipalities, you can challenge all but the central executive functions and the exercise of public authority.
The potential market is impressive. According to some estimates, 70 – 80 percent of local government activities can be outsourced through competitive tendering. Today, just over 10 percent of government activities are outsourced, which means that more than 60 % still waits to be challenged, with an estimated market value of 700-1000 billion SEK.
For municipalities, the right to challenge means opening up to new ways of thinking and organizing services to their constituencies. The municipality sends a signal to the surrounding society that if anybody can deliver the same standard of service cheaper and / or better than the municipality, they should step forward and try to do so.
In a sense, this political signal can also shape up and streamline the current organization providing the services. Therefore, by adopting the right to challenge, the municipality can ensure that taxes are used as efficiently as possible, whether the service is provided in house or not.
